These Terms & Conditions ("Terms") govern your access to and use of
hitbotanicals.com (the "Site") and any purchase you make through it. The Site
is operated by HIT Botanicals LLC, doing business as HIT Energy ("we", "us",
"our"), 1449 N Topping Ave, Kansas City, MO 64120, USA.

By accessing the Site or placing an order, you agree to these Terms and to our
Privacy Policy, Shipping Policy and Refund Policy, each of which is
incorporated here by reference. If you do not agree, please do not use the Site.

1. Eligibility
You must have the legal capacity to enter into a binding contract. By placing
an order you represent that you meet this requirement. This product is not
intended for children, or for pregnant or lactating women. Void where
prohibited by law.

2. Our products
We sell dietary supplement products. These statements have not been evaluated
by the Food and Drug Administration. This product is not intended to diagnose,
treat, cure or prevent any disease. Consult a physician before use if you have
a serious medical condition or take prescription medication. A doctor's advice
should be sought before using this or any dietary supplement product.

Product images are illustrative. Packaging, labelling and formulation may
change; the label on the product you receive controls. Always read the label
before use.

3. Orders and acceptance
Your order is an offer to buy. We may accept or decline any order, in whole or
in part, including where the product is unavailable, where there is an error in
the price or description, or where we suspect fraud or a breach of these Terms.
If we decline an order after you have been charged, we will refund you in full.

4. Pricing and payment
All prices are in U.S. dollars and exclude shipping and applicable taxes, which
are calculated at checkout. Prices may change at any time before you place an
order. If a product is listed at an incorrect price, we may cancel the order
and refund you.

Payment is taken at checkout by our payment processor. You confirm that you are
authorised to use the payment method you provide.

5. Shipping and delivery
Shipping terms, timeframes and international import responsibilities are set
out in our Shipping Policy. Risk of loss passes to you on delivery to the
carrier.

6. Returns and refunds
Your first order is covered by our first-order guarantee. If it is not for you,
email us within 30 days of delivery with your order number and we will refund
what you paid for the product. The guarantee covers one order per customer,
applies to your first purchase only, and does not apply to free or promotional
product, including giveaway and sample orders. Shipping charges are not
refunded.

Because our products are consumable goods we cannot accept returned items once
they have left our facility, so no return is required to claim the guarantee.
Beyond the first-order guarantee, later orders are not refundable, except for
orders that arrive damaged, defective or incorrect, which must be reported
within 7 days of delivery. Full details are in our Refund Policy.

7. Acceptable use
You agree not to use the Site unlawfully, to interfere with its operation or
security, to scrape or harvest data from it, to resell our products without our
written permission, or to misrepresent your identity.

8. Intellectual property
The Site and its content — including the HIT and HIT Energy names, logos, text,
images and layout — are owned by or licensed to HIT Botanicals LLC and are
protected by intellectual property laws. You may not copy or reuse them without
our written permission. All other trademarks and copyrights are the property of
their respective owners, are not affiliated with us, and do not endorse this
product.

9. Disclaimers
The Site and products are provided "as is" and "as available" to the fullest
extent permitted by law. We do not warrant that the Site will be uninterrupted
or error-free, or that any product will achieve a particular result for you.
Individual responses to dietary supplements vary.

10. Limitation of liability
To the fullest extent permitted by law, HIT Botanicals LLC will not be liable
for any indirect, incidental, special, consequential or punitive damages
arising from your use of the Site or any product. Our total liability for any
claim relating to a product is limited to the amount you paid for that product.
Nothing in these Terms limits liability that cannot lawfully be limited.

11. Indemnity
You agree to indemnify HIT Botanicals LLC against claims, losses and reasonable
costs arising from your breach of these Terms or your misuse of the Site or
products.

12. Governing law
These Terms are governed by the laws of the State of Missouri, USA, without
regard to its conflict of laws rules. Any dispute will be brought in the state
or federal courts located in Jackson County, Missouri, and you consent to their
jurisdiction.

13. Changes to these Terms
We may update these Terms from time to time. The version posted at the time you
place an order is the version that applies to that order.
